Terms of Service
Etxhe helps real estate professionals keep their clients informed. These terms explain the rules for using the website, agent workspace and client pages, and what you can expect from the service.
1. Who operates Etxhe
Etxhe is a service operated by Cristhian Etcheverry, an individual based in Virginia, United States (“Etxhe,” “we” or “us”). Etxhe is not a separate incorporated company. Contact us about the service or these terms at c.etcheverry@hotmail.com. This contact does not replace any legally required method of formal service of legal proceedings.
New agents agree to these terms when creating an account. Client recipients are shown links to these terms and our Privacy Notice before verifying access. If you accept these terms on behalf of a brokerage or another organization, you must have authority to do so. Do not create an account if you do not agree to these terms.
2. What the service does
Etxhe organizes journey updates, tasks, appointments and resources for invited clients, and stores email conversations and supported attachments received, imported or sent through the service. The agent controls what they publish; eligible client email replies can also appear as questions on the client page. Brokerage owners and authorized administrators may view records available to their role. A journey transfer changes which agent controls it, as described in our Privacy Notice.
Etxhe is a communication and organization tool. It does not provide brokerage, legal, tax, lending, investment or other professional advice. It does not replace signed agreements, professional recordkeeping, required notices or independent confirmation of deadlines. Confirm important dates and instructions with the responsible professional. Never rely on an Etxhe message alone to authorize a wire transfer or a change in payment instructions.
3. Accounts and secure access
Etxhe is for people who are at least 18 and legally able to enter into an agreement. Provide accurate account information and keep your email address current. Agents must use a passkey or a password with an authenticator app. Keep recovery codes private and stored securely. Do not share accounts or sign-in factors. Tell us promptly if you suspect unauthorized access.
Client links are intended only for the invited recipient. A new browser must verify access with a code sent to the invited inbox. Do not forward links or share codes. An agent may revoke access. Protect your devices and inbox; no online service can guarantee complete security.
4. Your information and responsibilities
You retain your rights in information you provide. You give Etxhe limited permission to host, process, display and transmit it as reasonably needed to provide, maintain, secure and support the service and comply with law, consistent with our Privacy Notice. This permission does not give us ownership of your content.
Agents must have the rights and permissions needed to upload information, forward or import communications and attachments, invite recipients, send messages and connect third-party accounts. This includes permission for Etxhe and its service providers to store and process that information as described in our Privacy Notice. Follow your brokerage’s rules, confidentiality duties, applicable privacy requirements, and messaging and marketing laws. Verify recipient addresses and review content before publishing or sending it. Check forwarded conversations and attachments for unrelated or confidential information before sending them to Etxhe. Do not upload or forward passwords, full payment-card details, Social Security numbers, government identity documents, bank credentials or other information unnecessary for a client journey. Use an appropriate dedicated service for highly sensitive documents.
Do not use Etxhe for unlawful activity, fraud, harassment, spam, impersonation or infringing content. Do not access another person’s information without permission, bypass access controls, disrupt the service or test systems without authorization. Report suspected security issues privately through the contact above.
5. Connected services and AI features
Optional features connect email and calendar accounts or use AI. You choose whether to connect an account or request an AI feature. A third-party provider’s own terms and policies also apply. You can disconnect supported accounts in Settings or revoke access through the provider. Email forwarding rules are managed with your email provider; disconnecting a connected account in Etxhe does not remove those rules or delete messages already stored in Etxhe.
AI output may be inaccurate or incomplete. Review it before using, publishing or sending it. Do not submit information you are not authorized to share with the relevant provider. Etxhe does not publish an AI draft without your approval. Our Privacy Notice explains the information sent to providers, including email text and conversation context used when you request an email draft or suggested page changes.
Disconnecting or deleting an account cannot recall messages already sent, information already downloaded, calendar entries already copied or information retained independently by a recipient or provider. Email and calendar delivery can be delayed or fail; confirm time-sensitive communications directly.
6. Privacy and retention
Our Privacy Notice explains the information Etxhe collects, how it is used and shared, and your choices. Agents are responsible for their own notices and lawful use of client information. Contact the agent about the contents of a client journey; contact Etxhe about operation of the service or an access or security problem.
Agents can export their data and delete their accounts in Settings. Export information you must keep and separately download any needed email attachments before deleting an account or page. Stored mail does not expire automatically, and archiving mail or a page is different from deletion. The Privacy Notice explains which records are removed when a page or account is deleted and what remains after a journey transfer. Message and attachment size limits mean Etxhe may not retain a complete copy of an email. Keep independent copies of records you are required to preserve. Deleting information in Etxhe does not delete copies that recipients or providers hold independently. We do not promise deletion from systems outside our control.
7. Availability, changes and charges
Features may change and the service may be interrupted for maintenance, provider failures or security work. Keep separate copies of records you are required to retain. We do not promise uninterrupted availability or that Etxhe satisfies every legal recordkeeping requirement.
Any fee, renewal term or cancellation condition must be disclosed and accepted before it applies to you. These terms do not authorize undisclosed charges.
We may update these terms and will provide reasonable notice of material changes through the service or account email. Changes apply prospectively from the stated effective date. We will obtain any additional agreement required by law. A change to these terms does not authorize us to disregard earlier privacy commitments for information already collected.
8. Suspension and ending use
You may stop using Etxhe at any time. Agents may delete their accounts through Settings. We may restrict or suspend access when reasonably needed to prevent harm, investigate misuse, comply with law or address a material breach of these terms. Where practical and safe, we will explain the issue and allow an opportunity to resolve it. Immediate action may be necessary for an urgent security or legal issue.
Ending use does not undo previously delivered communications. Provisions that by their nature need to continue, including responsibility for prior conduct, disputes and rights in content, continue to apply.
9. Service assurances and legal rights
We aim to provide a useful, secure service, but cannot guarantee that it is error-free or that every threat will be prevented. To the extent permitted by law, Etxhe is provided as available without implied warranties of merchantability, fitness for a particular purpose or non-infringement. Nothing in these terms excludes rights or remedies that cannot lawfully be excluded, or limits responsibility where doing so would be unlawful.
10. Governing law and disputes
Virginia law governs these terms, without displacing mandatory protections that apply where you live. Please contact us so we can try to resolve a concern. These terms do not require arbitration or prevent you from contacting a regulator or using a court with proper jurisdiction. If a provision is unenforceable, the remaining provisions continue to apply to the extent permitted by law.
